Beta Service Notice
Tidal AI is currently in beta. Features may change, performance is not guaranteed, and some functionality may be unavailable at times. By using Tidal AI, you acknowledge and accept the beta nature of the service.
1. Acceptance of Terms
Tidal AI ("the Service") is operated by tidalai LLC, a Georgia limited liability company ("tidalai," "we," "us," or "our").
By creating an account or using Tidal AI ("the Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.
If you are using Tidal AI on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Your Account
You are responsible for:
- Keeping your login credentials secure and confidential.
- All activity that occurs under your account.
- Ensuring the information you provide (name, email, business details) is accurate and kept up to date.
You must be at least 18 years old to create an account. Accounts are personal — you may not share, sell, or transfer your account to another person or entity.
3. The Service
What we provide
Tidal AI provides AI-powered tools that generate marketing assets — including websites, ad campaigns, ad creatives, email sequences, brand strategies, content calendars, and follow-up funnels — based on inputs you provide. We also offer a marketing audit tool that is always free.
AI-generated content
The content Tidal AI generates is produced by AI models and is not guaranteed to be accurate, complete, legally compliant, or suitable for your specific situation. You are solely responsible for reviewing, editing, and determining whether AI-generated content is appropriate before using it in your business.
You own the content generated for your projects. Tidal AI claims no intellectual property rights over your outputs. However, you grant Tidal AI a limited license to store and display that content to provide the Service to you.
Your responsibility for published content
Before you publish, send, or otherwise use any AI-generated content (websites, ads, emails, social posts, audits, brand assets, or any other output), you agree that you will review it for accuracy, legality, and fitness for your specific business. This includes — but is not limited to:
- Verifying every factual claim (statistics, prices, hours, service areas, certifications, awards) is true for your business.
- Confirming any testimonials, reviews, or quoted customer language reflect real customers who have agreed to be quoted.
- Confirming the content complies with all laws and platform policies applicable to your industry (FTC advertising guidelines, healthcare advertising rules, financial services disclosures, alcohol/CBD/firearms restrictions, etc.).
- Confirming the content does not infringe any third party's trademarks, copyrights, or other rights.
- Confirming the published content (including websites built with Tidal AI) meets accessibility requirements such as the Americans with Disabilities Act (ADA) and WCAG, where applicable to your business.
You agree that Tidal AI is not liable for any claims, damages, fines, lawsuits, or other consequences arising from inaccurate, misleading, infringing, non-compliant, or otherwise problematic content that you publish, send, or use — regardless of whether the content originated from an AI model in our platform. The platform produces drafts. You are the publisher.
Image generation
Images generated through Tidal AI are produced by third-party AI image models (currently Google Gemini). You may use those images for your business as permitted by the underlying model's usage policy. Tidal AI does not warrant that generated images are free from resemblance to existing works, real people, or trademarked material — review every image before use.
No professional advice
Tidal AI does not provide legal, financial, medical, or professional advice. Marketing outputs are suggestions only. Consult appropriate professionals before making significant business decisions.
4. Credits and Billing
Subscription and credits
Tidal AI operates on a credit system. Each plan includes a monthly credit allocation. Credits are consumed when you run builds (website, ad campaign, email sequence, etc.). Credit costs per build type are listed on our Pricing page and in your account billing settings.
Billing cycle and automatic renewal
Paid plans are billed monthly. Credits reset at the start of each billing cycle. Unused credits do not roll over to the next cycle.
Automatic renewal — please read carefully. When you purchase a paid plan, your subscription renews automatically at the end of each billing cycle, and your payment method on file will be charged the then-current monthly price (currently $20/month for Starter, $49/month for Pro, $99/month for Growth, $249/month for Agency). This automatic renewal continues until you cancel. By starting a paid plan, you authorize Tidal AI to charge your payment method on a recurring monthly basis.
How to cancel. You can cancel anytime from your account's Billing page. Cancellation takes effect at the end of your current paid period — you keep access through the end of the period you already paid for, and you will not be charged again. We do not require you to call, email, or chat to cancel.
Trial-to-paid conversion. The Starter plan includes a 30-day free trial. When you start a paid plan you provide a payment method up front, and after the free trial ends your plan automatically renews at the then-current price unless you cancel before the trial ends. You can cancel anytime from your billing page; we send a reminder before your trial ends. The Free tier never requires a card and is never charged.
Refunds
Credits consumed for successful builds are non-refundable. If a build fails due to a platform error on our end, credits are automatically refunded to your account. We do not offer cash refunds for unused credits or partial billing periods. To cancel and avoid future charges, cancel before your next renewal date.
Price changes
We may change subscription prices with at least 30 days' notice via email. Price changes take effect at your next renewal after the notice period. Continued use after the effective date constitutes acceptance of the new price.
5. Acceptable Use
You agree not to use Tidal AI to:
- Generate content that is illegal, defamatory, harassing, threatening, or fraudulent.
- Create spam, phishing campaigns, or deceptive advertising.
- Impersonate another person, company, or brand without authorization.
- Violate any applicable advertising standards, FTC guidelines, or consumer protection laws.
- Reverse-engineer, scrape, or attempt to extract the underlying AI models or platform code.
- Use automated tools to generate builds at scale beyond your plan limits.
- Resell access to the Service without our written permission.
We reserve the right to suspend or terminate accounts that violate these rules without refund.
Sending generated content — your compliance responsibility
Tidal AI generates marketing copy, email sequences, SMS scripts, and similar communications. You are solely responsible for ensuring that any communication you actually send (email, SMS, push, postal mail, or otherwise) complies with all applicable laws and platform policies, including but not limited to:
- Email (CAN-SPAM Act, GDPR, CASL, and equivalent): obtain proper consent before sending marketing email, include a working unsubscribe link in every marketing message, include a valid physical postal address, honor opt-out requests within 10 business days, and never use deceptive subject lines or sender identification.
- SMS / text messaging (TCPA, state mini-TCPAs, and equivalent): obtain prior express written consent from each recipient before sending marketing text messages, honor STOP/UNSUBSCRIBE requests immediately, comply with carrier requirements (10DLC registration, sender ID rules, opt-in language), and never send to numbers on the National Do Not Call Registry without an applicable exemption.
- Telemarketing (TCPA): if generated content is used in phone outreach, comply with calling-time restrictions, Do Not Call lists, and prerecorded-message consent rules.
- Industry-specific advertising rules applicable to your business (FDA for health claims, FTC for endorsements and pricing, FINRA for financial services, alcohol/cannabis/firearms restrictions, etc.).
Penalties under TCPA can reach $500 to $1,500 per unsolicited text message or call; CAN-SPAM penalties can exceed $50,000 per non-compliant email. You agree that Tidal AI is not responsible for, and has no ability to monitor, your compliance with these laws when you choose to send generated content. We provide drafts; you decide whether, when, to whom, and how to send.
6. Intellectual Property
Your content
You retain ownership of all business information, brand assets, and inputs you upload to Tidal AI. You own the AI-generated outputs created from your inputs. You grant us a limited, non-exclusive license to use your inputs solely to deliver the Service.
Our platform
The Tidal AI name, logo, software, design, and all platform technology are owned by Tidal AI and protected by intellectual property laws. You may not copy, modify, or distribute any part of our platform without express written permission.
7. Beta Status — Special Risk Acknowledgment
Tidal AI is currently a beta product. By using the Service, you specifically acknowledge and accept that:
- Features may change, regress, or be removed without notice. The product is actively evolving and we may modify, deprecate, or replace any feature at any time.
- Performance, availability, and reliability are not guaranteed — there is no service-level agreement (SLA) during beta. Outages, slowdowns, and intermittent failures should be expected.
- Data loss is possible. Although we use industry-standard backup practices (Supabase managed Postgres with point-in-time recovery), bugs, infrastructure failures, or data-restoration limitations could cause loss of projects, conversations, business brain data, or generated content. You agree to maintain your own backups of any output you consider important.
- AI output quality is under active tuning and may vary build-to-build as we improve prompts, models, and pipelines.
- Pricing, credit costs, and plan limits may change as the product matures. We will give at least 30 days' notice before increasing prices on existing paid subscribers, as described in Section 4.
You agree that Tidal AI is not liable for any loss arising from the beta nature of the Service, including loss of generated content, business information, time, or revenue. The disclaimers and liability limitations in Sections 8 and 9 below apply in full.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) AI-generated content will be accurate, complete, or suitable for your business; (c) results from using the Service will meet your expectations; or (d) defects will be corrected.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIDAL.AI AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA — ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO TIDAL.AI IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.
10. Indemnification
You agree to defend, indemnify, and hold harmless Tidal AI from any claims, damages, losses, or expenses (including attorney fees) arising from: (a) your use of the Service; (b) content you submit; (c) your violation of these Terms; or (d) your violation of any third-party rights.
11. Termination
By you
You may cancel your account at any time from your billing settings. Cancellation takes effect at the end of your current billing period. Your data will be retained for 30 days after cancellation and then deleted.
By us
We may suspend or terminate your account immediately if you violate these Terms, engage in fraud, or if required by law. We may also discontinue the Service with 30 days' notice to all users.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, unless you opt out within 30 days of first agreeing to these Terms by emailing brock@tidalai.app.
You waive any right to participate in a class-action lawsuit or class-wide arbitration.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
